The Role Of Mediation In Divorce

Mediation is a process in which both spouses work with their attorneys and a neutral third party, the mediator, to reach mutually-agreeable terms. Mediators are not judges. Most often, they are lawyers with extensive family law experience and who are intimately familiar with how a judge will react to given arguments. A skilled mediator will help couples understand each other’s positions and offer unique resolutions.

For mediation to work, divorcing couples will need to be willing to compromise with one another. This means agreeing to previously disagreeable terms or giving up assets in return for the other spouse doing the same.

Arbitration Can Save Time And Money

Arbitration is an alternative resolution method that also introduces a third party. The distinction is that this party renders a decision. The role of an arbitrator is to be presented with all available evidence, then to give their judgment on the circumstances. They do not facilitate negotiations in the same way a mediator does.

Arbitrators are not judges. In most cases they are also experienced attorneys with a high-level insight in family law. Once they have made their decision it will still need to pass a judge’s bench in court for the divorce to be finalized.
